Eminent Domain Hearing Rescheduled Until After Municipal Election

In Uncategorized on April 28, 2008 at 4:13 pm

The Village of Ridgewood vs. Ridgewood 120 LLC Power of Eminent Domain hearing was rescheduled from Friday, April 25 to Friday, May 16. This hearing concerns the Village’s court filing to exercise power of eminent domain rights for the property at 120 Franklin Avenue.

As previously reported on this Blog, the principals of Ridgewood 120 LLC have filed a separate motion in Superior Court alleging Village of Ridgewood officials broke “secret” promises related to Ridgewood 120 LLC’s purchase of the former Town Garage property.

Elections for three open Village Council seats will be held on Tuesday May 13. How convenient is it for the incumbents that no dirty laundry will be revealed in open court until three days after the election is over. Nice calendar shuffle on the part of Village Attorney Matt Rogers. For those who might like to attend the hearing, it will be held in Room 323 of the County Courthouse, Main Street, Hackensack, at 9:00 AM on Friday, May 16. The presiding judge will be the Honorable Peter E. Doyne.

  1. James… In my opinion…

    1. Rescheduled Eminent Domain hearing from April 25th to May 16 not caused by Village…. but by the motion by Ridgewood 120 .. to be held on what date (?) … obviously will have to be after the election.

2 You need a copy of the motion (asking for what?) To delay, obstruct or other. What relief are they asking for monetary? Then I believe, would be a tort action and not be part of the May 16th meeting.

3 It makes no difference who is in office … the “taking” of that property is part of the Village’s advanced plan to upgrade the entire approved section for the “parking garage” and additional retail space”… Nothing illegal about that.

4 Mis information provided by any third parties … candidates for office or others that don’t have a “legal standing” will be quickly be dismissed, in my opinion.

Be cautious…. We all like to play lawyer… even me. Thanks…. Dom
